GREGORY M. LA SORSA, born Bronx, New York, September 18, 1957; admitted to bar, 1983, New York State and the U.S. District Courts, Southern and Eastern Districts of New York. Mr. La Sorsa has distinguished himself as a trial attorney in the defense of negligence (and medical malpractice) cases, first developing his skills at the prestigious Garbarini & Scher, where he was associated with some of the top trial attorneys in New York City.

While at Garbarini & Scher, Mr. La Sorsa successfully tried a number of defense cases to verdict, including a well-publicized medical malpractice case involving a television celebrity and a plastic surgeon. Mr. La Sorsa also developed a system of legal seminars and in-house training while at Garbarini, lecturing clients on claims management and loss prevention issues.

During his tenure at Issler & Schrage, Mr. La Sorsa developed a defense practice at the firm, representing several clients who followed him there. Mr. La Sorsa also devised innovative and competitive billing programs for his firm=s legal representation, which he carried over to the institution of La Sorsa & Beneventano.

Mr. La Sorsa founded La Sorsa & Beneventano in 1995. He is an experienced litigator who is at home in the courthouse as well as behind the scenes. He has tried almost 100 cases to verdict. After spending years on the defense side of the bar, with a heavy involvement in the defense of no-fault asset recovery matters, both Mr. LaSorsa & Mr. Beneventano decided to switch the firm=s focus to the representation of medical providers in insurance claim recovery matters. That aspect of the practice has blossomed and LaSorsa & Beneventano now plays a major role in the field of No-Fault Asset Recovery, recovering on $40,000,000.00 of unpaid claims. In addition, Mr. La Sorsa has been involved with billing and management issues for medical providers, having represented several billing companies engaged in no-fault, workers comp and major medical invoices.

Mr. La Sorsa has been instrumental in helping to shape corporate structure and independent contractor law in New York as it pertains to medical providers, and has been influential in developing strategies to address carrier attempts to thwart recoveries via verification and EUO delaying tactics. He has chaired conferences regarding strategies for recovery of medical assets and given seminars on billing strategies and techniques.

THOMAS M. Mr. Beneventano began his career as an Assistant Corporation Counsel for the City of New York. He first worked in the Commercial Litigation unit, defending the City in construction-related lawsuits by contractors and others. He then transferred to the Tort Litigation Unit and honed his skills as a trial attorney defending numerous personal injury/general liability/ and other matters, and eventually became responsible for defending some of the most serious tort cases against the City, as well as supervising other City attorneys in an entire IAS Part of the New York State Supreme Court.

In private practice, Mr. Beneventano has concentrated on developing his skills in asbestos litigation, products liability, professional liability, commercial and construction litigation, motor vehicle accident litigation, municipal liability, premises liability, and other negligence-related areas, in addition to no-fault suits on behalf of health care providers. His engineering background combined with his practical “hands-on” experience enables him to communicate effectively with engineers and scientists, as well as with judges, juries and lay witnesses. This ability has been particularly helpful in asbestos litigation, construction litigation matters and in the accident reconstruction aspect of cases, as well as in developing engineering oriented defenses in products liability, motor vehicle accident litigation, and other serious cases.

While at the firm of Townley & Updike, Mr. Beneventano was the New York City Housing Authority Defense Team Leader. As such, he defended numerous premises liability matters including elevator accidents, slip/trip and fall, boiler explosions, inadequate security, etc. He also was responsible for preparing a training program for litigation associates at the firm.

At Skadden, Arps, Slate, Meagher & Flom, Mr. Beneventano became involved in the coordination and nationwide defense of product liability, asbestos, and negligence related litigation. At the same time, Mr. Beneventano headed Skadden’s defense team for a well-known leasing company and tried a well-publicized tower-crane case in New York during that period. He was also instrumental in defending asbestos litigation defendants and defendants involved in ethylene oxide litigation. His engineering background and combined courtroom skills proved to be highly valuable it all of the above matters.

At La Sorsa & Beneventano, Mr. Beneventano represents clients in a wide variety of matters involving asbestos litigation, automobile, products liability, commercial, construction, environmental, and other insurance-related issues. He has also represented attorneys and other professionals sued in their professional capacities. He was instrumental in developing the Asbestos Defense and No-Fault Asset Recovery branches of the firm’s practice, and through his efforts, has developed a number of significant contacts in the Asbestos and No-Fault Insurance industries. He excels in defending asbestos litigation matters through effective depositions and discovery and has been successful in obtaining highly favorable resolutions of asbestos matters for our clients. He also excels at early resolution of no-fault cases.

With respect to Asbestos Litigation, Mr. Beneventano has managed, overseen, and defended hundreds of cases filed throughout New York State against major asbestos litigation defendants and minor defendants as well. This process has incorporated all pleadings, documentary discovery, depositions, expert discovery, motions and all types of court appearances and proceedings through the resolution of these cases.

In addition, Mr. Beneventano serves as Special Counsel to the Golden’s Bridge Fire District. In that role, he draws upon all of his experiences in the profession, which began with defending municipal liability cases involving construction-related matters and personal injury cases as well.

Justyn was born and raised in Yonkers, New York and prides himself on working hard, asking questions and being vigorously dedicated to improvement day in and day out. The oldest of five children, Justyn began working in the restaurant industry at the age of 14 and has maintained a sense of great responsibility and desire to improve.

In 2014, Justyn moved into White Plains, New York where he began to work on networking in the area and acquiring his legal degree at Pace University. While in law school, Justyn worked as a bartender before eventually moving on to legal work. Justyn started his legal career as a summary judgment law clerk for Progressive House Counsel. At Progressive, Justyn was focused on Personal Injury Litigation and was responsible for the drafting, revision and filing of both liability and threshold summary judgment motions. After spending a year in this role, Progressive filed 50 motions more than the year prior and saw a 10% increase in settlement of claims. Before leaving, Justyn created templates for liability summary judgment motions on issues ranging from the emergency doctrine, rear end collisions, left hand collisions as well as threshold summary judgment motion templates for each respective provision enumerated in New York State Insurance Law 5102(d).

After Progressive, Justyn spent time working as a clerk for a solo practiconer focused on Real Estate Law and Construction Law; which included handling and filing of mechanics liens. Through this experience, Justyn was able to gain first-hand experience with the Court systems and sat second chair to a trial in Westchester County that resulted in a $100,000 verdict on the theory of unjust enrichment.

Justyn took the New York State Bar in the July, 2018 and took a position at La Sorsa & Beneventano in September of 2018; with a directed focus of handling personal injury, general liability, no-fault recovery and medical malpractice. At the onset, Justyn was responsible for client intakes, drafting discovery, electronic filing, court filings, and assisting the partners in legal research as well as drafting of motions and other responsive pleadings. Upon his February 6, 2019 admission to the New York State Bar, Justyn then expanded his role in the firm and immediately started attending preliminary conferences as well as compliance conferences in Westchester, Bronx, New York, Brooklyn and Queens.

Over the course of several months, under the tutelage of Mr. La Sorsa and Mr. Beneventano, Justyn learned how to handle a case from the cradle to the grave. In addition to being responsible for client intake, Justyn learned the nuances of managing client expectations and providing sound legal advice. Mr. La Sorsa & Mr. Beneventano continually provided thorough and specific information about obtaining the discovery necessary to make out a prima facie case for a variety of lawsuits. In addition to teaching an extreme attention to detail, La Sorsa & Beneventano also provided the opportunity to learn the various aspects of settling lawsuits.

In July of 2019, Justyn became the handling attorney for La Sorsa & Beneventano’s No-Fault Recovery. During this time, Justyn appeared daily at the Bronx County Courthouse and took part in dozens of trials on the issue of the medical necessity of a claim, as well as various trials on evidentiary issues. Over time, Justyn began to settle large volumes of the No-Fault claims, through in court and out of court settlements. This was highlighted by a recovery of $30,000 on a singular claim and a high-water mark of over $150,000 recovered in October of 2019.

After establishing a rhythmic nature to the handling of the No-Fault claims, Justyn became more involved in the assistance in handling the personal injury, general liability and medical malpractice cases at La Sorsa & Beneventano. In addition to maintaining an aggressive approach in obtaining necessary discovery and attending various conferences, Justyn conducted and defended several depositions related to motor vehicle accidents.

Under the advice, guidance and instruction of Mr. La Sorsa & Mr. Beneventano, Justyn has fast-tracked the first year of his legal career and is constantly hungry for more responsibility within the firm.
